This Agreement contains the complete terms and conditions that apply to an individual's or entity's participation in the MmoGah.com Affiliate Program (the "Program"). As used in this Agreement, "we," "us," or "MmoGah" refers to MmoGah.com, and "you" or "Affiliate" refers to the applicant.

By submitting an application to join the Program, you acknowledge that you have read this Agreement and agree to be bound by all its terms and conditions.

1. Enrollment and Acceptance
To begin, you must submit a complete Affiliate Program application through our website. We will evaluate your application in good faith and notify you of its acceptance or rejection. We reserve the right to reject any application if we determine, in our sole discretion, that your site or promotional methods are unsuitable for the Program.

Unsuitable sites include, but are not limited to, those that:

    Promote sexually explicit materials, violence, or illegal activities.

    Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

    Infringe upon or otherwise violate any copyright, trademark, or other intellectual property rights. This includes sites that promote software piracy, hacking, or "cracked" versions of games.

    Are designed to deceptively mimic the look and feel of our official website, MmoGah.com.

    Are otherwise in violation of any applicable laws.

2. Affiliate Responsibilities & FTC Disclosure
As an Affiliate, you are solely responsible for the development, operation, and maintenance of your site and for all materials that appear on it. You must ensure that materials posted on your site do not violate or infringe upon the rights of any third party and are not libelous or illegal.

Crucially, you must clearly and conspicuously disclose your affiliate relationship with MmoGah in close proximity to any and all affiliate links. Your disclosures must comply with all Federal Trade Commission (FTC) guidelines. Examples of acceptable disclosures include:

    "(As an MmoGah Affiliate, I earn from qualifying purchases.)"

    "This post contains affiliate links, which means I may earn a commission if you make a purchase."

    On platforms like Twitter or YouTube descriptions: Using #ad or #sponsored.

3. Marketing Guidelines and Restrictions
To protect our brand integrity and ensure fair competition, you must adhere to the following marketing guidelines. Violation of these terms is grounds for immediate termination and forfeiture of all outstanding commissions.

    A. Prohibited PPC Bidding (Pay-Per-Click): You are strictly prohibited from bidding on any MmoGah branded keywords for any search engine marketing. This is our most important rule. The purpose of the Program is to attract new customers, not to compete with our own advertising for users already searching for us.

        Forbidden Keywords Include: MmoGah, MmoGah.com, Mmo Gah, MmoGah reviews, MmoGah coupon, and any other variations or misspellings of our brand name.

        Guidance: You are encouraged to bid on generic, service-related keywords.

            Good Example: "buy ffxiv gil," "wow gold for sale," "best site to buy game currency."

            Bad Example: "MmoGah wow gold," "MmoGah coupon code."

    B. Domain Names and Social Media: You may not use our trademarks, or any variation or misspelling of them, in your domain names, social media profile names, or page names. For example, a site named MmoGah-Deals.com or a Twitter handle like @MmoGah_Coupons is prohibited.

    C. Coupon and Deal Sites: We reserve the right to reduce or decline commissions generated from websites whose primary purpose is to post coupon and discount codes. While you may use officially provided coupons in your content, affiliates whose business model relies solely on ranking for "[Brand] + Coupon" terms and offering no other value will have commissions voided.

    D. Ad Copy and Content: You may not impersonate MmoGah in your advertisements or content. This includes using phrases like "Official Site" or creating ads that could mislead a user into believing they are clicking on an official MmoGah communication. All promotions must be truthful and not misrepresent our services.

    E. SPAM: We have a zero-tolerance policy for spam. This includes unsolicited emails, unauthorized link posting in forums or comment sections, and any other mass-messaging that is not compliant with the CAN-SPAM Act. Any verified SPAM complaint will result in the immediate termination of your account and forfeiture of any commissions owed.

4. Linking and Link Materials
Upon acceptance, we grant you a non-exclusive, revocable license to use the textual and graphical links ("Link Materials") provided by us to link your site to MmoGah.com. You agree to:

    Use only the approved Link Materials available in your affiliate dashboard.

    Not alter, modify, or change the look and feel of the Link Materials in any way.

    Not engage in link cloaking or use misleading redirects that obscure the fact that the user is being directed to MmoGah.com.

    Ensure your affiliate links are formatted correctly. We are not responsible for lost commissions due to improperly formatted links.

5. Commissions, Payments, and Tracking
MmoGah will track sales referred by your unique affiliate links. Our system is the official and definitive record of all traffic and commissions earned.

    Commission Payouts: Commissions are paid out on a defined schedule (e.g., Net-30), provided your account balance has met the minimum payment threshold of $200.00 USD.

    Tracking Failures: You acknowledge that our tracking system, while robust, may not be 100% fail-safe. We are not liable for commissions lost due to circumstances beyond our reasonable control, such as a user intentionally clearing cookies or an affiliate's failure to use the proper link format.

    Commission Reversals: We reserve the right to reverse commissions for any of the following reasons:

        The transaction was identified as fraudulent.

        The customer requested a refund or initiated a chargeback.

        The commissions were earned in violation of any term in this Agreement.

6. Modification of Agreement
We may modify any of the terms and conditions in this Agreement at any time and at our sole discretion by posting a change notice or a new agreement on our site. Modifications may include, for example, changes in referral fees, payment procedures, or Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING THE POSTING OF A CHANGE WILL CONSTITUTE YOUR BINDING ACCEPTANCE OF THE CHANGE.

7. Term and Termination
The term of this Agreement begins upon our acceptance of your application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination (email shall be considered sufficient written notice). Upon termination, you are only eligible to earn referral fees on sales that occurred during the term.

8. Relationship of Parties
You and MmoGah are independent contractors. Nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You have no authority to make or accept any offers or representations on our behalf.

9. Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement will not exceed the total referral fees paid or payable to you under this Agreement in the six (6) months preceding the event giving rise to the claim.

10. Miscellaneous
This Agreement will be governed by the laws of the State of California, United States, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Orange County, California, and you irrevocably consent to the jurisdiction of such courts. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision.
